Rent & Real Estate Litigation

Ejectment petitions, rent disputes and title litigation — before Rent Controllers and civil courts.

Overview

Property Disputes Are Won on Documents

Punjab's rent laws give both landlords and tenants defined rights — and ejectment follows statutory grounds and a set procedure, not force, not lockouts, not cutting utilities. A landlord who skips that procedure often finds the law protecting the tenant instead. Knowing the lawful route, and following it precisely, is what gets possession back without creating a second case.

Title disputes are a different battlefield, and they turn on the chain of documents: the registered deed, the revenue record, the fact of possession. Where the chain has a gap — an unregistered transfer, a missing mutation, a family partition never reduced to writing — someone will eventually exploit it. We read the whole chain before we advise a single step.

Illegal dispossession is the emergency of property law. The law provides swift remedies, including criminal ones, for a person thrown off their property — but speed matters enormously. Every day of delay hardens the other side's position and complicates the record. If you have been dispossessed, the first call should be immediate.

Our approach is deliberately unglamorous: a document audit first, then the right forum — the Rent Controller for tenancy matters, the civil court for title — chosen deliberately, not by habit. Cases pleaded on complete records settle faster, cost less, and win more often.

Services

What Our Property Practice Covers

From tenancy to title, argued on records.

Ejectment Petitions

Lawful eviction on statutory grounds: default in rent, subletting, personal need and other recognised grounds — pursued before the Rent Controller with the evidence the law demands.

Rent Fixation & Enhancement

Fair-rent proceedings and lawful enhancement of rent, argued on comparables and the record — for landlords seeking a fair return and tenants resisting arbitrary hikes.

Title & Possession Suits

Establishing and defending ownership in the civil court: declarations, possession and permanent injunctions, built on a verified chain of title.

Illegal Dispossession Remedies

Swift action when possession is taken by force or fraud, including the criminal remedies the law provides — because in these matters, days decide outcomes.

Pre-Purchase Title Audit

Verifying the full chain of title before you pay: deeds, revenue records, mutations and encumbrances — the cheapest dispute is the one you never buy into.

Landlord–Tenant Advisory

Drafting and reviewing tenancy agreements, and compliance advice for both sides — so the relationship starts on paper, not on trust alone.

Process

How an Engagement Works

STEP 01

Document Audit

Deeds, revenue records, tenancy agreements and the possession history are examined line by line. We find the gaps before the other side does.

STEP 02

Forum Selection

Rent Controller or civil court? Ejectment or declaration? The forum is chosen deliberately, because the wrong court costs years.

STEP 03

Filing & Evidence

The case is pleaded on documents, not assertions — with the evidence organised the way the forum expects to see it.

STEP 04

Decree & Execution

A judgment is only paper until it is enforced. We follow through to execution: possession delivered, rent recovered, record corrected.

Who It's For

Built for Owners and Occupiers

Property disputes cut across both sides of the tenancy line — and beyond it. We act for:

  • Landlords with defaulting or overstaying tenants — lawful ejectment and recovery of arrears.
  • Tenants facing illegal eviction or lockout — protection of lawful possession and tenancy rights.
  • Buyers verifying title before purchase — a clean chain before money changes hands.
  • Families in inheritance-linked property disputes — partitions and titles tangled across generations.
One principle governs all four: In property law, possession is nine-tenths — and paperwork is the tenth that decides.

One rule we give every client: never pay for property before the title chain is verified. It is a sentence that has saved fortunes.

Why Prestige

Forum Precision, Followed Through

Property litigation rewards choosing the right court — and finishing what you start.

Forum precision

Rent Controller versus civil court is a strategic decision, not a habit. We choose deliberately, and we plead to that forum's procedure.

Title-chain expertise

Revenue records, mutations and registered deeds read properly — the unglamorous work on which title cases actually turn.

Execution followed through

Decrees enforced, possession delivered, records corrected. We do not consider a matter closed at judgment.

FAQ

Common Questions on Property Disputes

How can a landlord legally evict a tenant?

Through an ejectment petition before the Rent Controller on recognised statutory grounds — such as default in payment of rent, subletting without consent, or the landlord's genuine personal need. Self-help eviction — changing locks, cutting utilities, throwing out belongings — is unlawful and can expose the landlord to legal action. The lawful route takes procedure, but it is the route that holds.

Can rent be increased arbitrarily?

No. Enhancement of rent is governed by the applicable rent law and the terms of the tenancy agreement. A landlord seeking higher rent must follow the lawful process, and a tenant facing an arbitrary hike can resist it. We advise both sides on what the law actually permits in their situation.

What if someone illegally occupies my property?

Act immediately. The law provides remedies against illegal dispossession, including criminal remedies, and speed is decisive — delay allows the occupier to manufacture a record of possession. We move fast: documenting the dispossession, choosing the right remedy, and pressing it without pause.

What documents prove ownership of property?

Ownership is proved by a chain, not a single paper: the registered title deed, the revenue record showing ownership and mutations, and the fact of possession. Any break in that chain — an unregistered transfer, a missing mutation — is where disputes begin. We verify the complete chain before advising.

How long do rent cases take?

Rent matters are meant to proceed summarily and faster than ordinary civil suits, but actual pace varies with the forum's workload and the complexity of the dispute. No honest adviser can promise a date. What we do is press every matter for progress — complete filings, no adjournments sought by us, and active follow-up at each hearing.

Should documents be checked before buying property?

Absolutely — and before any payment, not after. A pre-purchase title audit verifies the seller's chain of title, the revenue record, mutations and any encumbrances. Most property frauds we see would have been visible in the record to anyone who looked. We look.
