International Commercial Arbitration
Cross-border dispute resolution — arbitration clauses, proceedings and award enforcement.
When Business Crosses Borders, So Do Disputes
When companies from different countries sign a contract, they rarely agree on whose courts should hear a dispute. That is why international contracts choose arbitration: a neutral forum, decision-makers with commercial expertise, proceedings that stay private, and — most importantly — awards that travel across borders more readily than court judgments under the international enforcement framework.
In arbitration, the clause decides everything. The seat of arbitration, the applicable rules, the language, the number of arbitrators and the governing law are all settled in a few lines of the contract — long before any dispute exists. A well-drafted clause gives you a clear, enforceable path; a badly drafted one creates the very dispute it was meant to prevent.
Prestige Law Firm works across that entire arc. We draft arbitration clauses for cross-border contracts, represent clients in institutional and ad hoc proceedings, enforce foreign arbitral awards through the courts in Pakistan, and — where the law permits — resist the enforcement of awards made against our clients.
Arbitration is private and procedurally controlled, but it is still advocacy. Evidence must be marshalled, witnesses examined and legal argument pressed with the same rigour as a trial. We run arbitrations the way we run court cases: prepared, precise and present.
What Our Arbitration Practice Covers
From the clause to the award — and beyond.
Arbitration Clause Drafting
The seat, rules, language, number of arbitrators and governing law — settled in clear language before a dispute arises, so the clause works when it matters.
Institutional & Ad Hoc Proceedings
Representation in proceedings under major institutional rules or in tailored ad hoc arbitration, from constitution of the tribunal to the final hearing.
Enforcement of Foreign Awards in Pakistan
Recognition and execution of foreign arbitral awards through the courts — pursued until the award produces results.
Resisting Enforcement
Where the law permits, challenging recognition of awards on the narrow grounds available — argued precisely, never speculatively.
Cross-Border Investment Disputes
Disputes involving foreign parties, cross-border investments and state-linked dimensions, handled with commercial as well as legal perspective.
Mediation & Negotiated Settlement
Resolving disputes without a full hearing where it serves the client — from a position of prepared strength, not weakness.
How an Engagement Works
Case & Clause Review
We study the agreement and the dispute: what the clause says, what it omits, and where you actually stand.
Strategy
Seat, rules, tribunal and the shape of your case — decided deliberately before proceedings begin.
Proceedings
Pleadings, evidence and hearings — run with litigation-grade advocacy at every stage.
Award & Enforcement
The award is the milestone, not the finish line; we carry it through to enforcement and results.
Built for Cross-Border Business
Arbitration clauses appear wherever business crosses a border. Our practice serves four common profiles:
- Exporters and importers locked in payment or delivery disputes with foreign counterparties.
- Companies with foreign partners or shareholders, where the contract chose arbitration over any national court.
- Contractors and suppliers in cross-border projects, facing claims or defending their own.
- Investors protecting overseas exposure, where a neutral forum matters more than a home advantage.
Most arbitration disasters are not created in the hearing room. They are drafted years earlier, at the signing table, in a clause nobody read twice. We read it twice — before you sign.
Advocacy Without Borders
Arbitration rewards the same qualities as trial — preparation, precision and presence.
Litigation-grade advocacy
We argue cases; we do not just file papers. Cross-examination, evidence and legal argument are our daily craft.
Corporate and tax perspective
Cross-border deals carry structural and tax consequences. Our corporate and tax consultancy reviews the deal behind the dispute.
Principal-led representation
Asghar Ali, Advocate High Court and Senior Legal Consultant, leads the mandate personally — from clause to award.

Common Questions on International Arbitration
What is international commercial arbitration?
It is private, binding dispute resolution outside national courts, chosen by the parties in their contract. Instead of a judge, one or more arbitrators decide the dispute, and the resulting award can be enforced across borders.
Arbitration or court litigation — which is better for my dispute?
It depends on the contract, the parties and what matters most — neutrality, confidentiality, enforceability or cost. We assess your clause and your dispute, then advise honestly which forum serves you.
Are foreign arbitral awards enforceable in Pakistan?
Yes — Pakistan has a legal framework for the recognition and enforcement of foreign arbitral awards, subject to conditions and procedure. We assess your award against those requirements and carry it through the courts.
What should an arbitration clause contain?
At minimum: the seat of arbitration, the applicable rules, the number of arbitrators, the language and the governing law of the contract. We draft clauses that answer these questions clearly, before a dispute tests them.
How long does an arbitration take?
It varies with the complexity of the dispute, the tribunal and the parties’ conduct. Arbitration is generally more procedurally controlled than court litigation, but no honest adviser can promise a fixed timeline.
Can we settle a dispute during arbitration?
Yes — and well-run arbitrations often settle. Settlement from a position of prepared strength usually produces better terms than settlement from fear. We negotiate when it serves you and fight when it does not.
