Banking & Commercial Law
Recovery suits, Banking Court representation and commercial agreements that hold up.
Money Disputes Need Banking-Law Precision
Banking disputes in Pakistan run under a special regime. The Financial Institutions (Recovery of Finances) Ordinance, 2001 created Banking Courts with their own procedure — distinct from ordinary civil suits in pace, pleading and proof. A lawyer who treats a banking matter like an ordinary civil suit is already behind.
For borrowers, the law is not one-sided: defences exist — limitation, incorrectly computed mark-up, procedural defects in the institution's own case — and they are won on the statement of account, reconciled line by line. For financial institutions and businesses owed money, recovery is a strategy: the right forum, the right sequence, and documentation that survives scrutiny.
Commercial contracts are where most disputes are truly decided — long before anyone reaches a courtroom. A contract that is vague on payment terms, timelines, breach consequences or dispute resolution is a dispute waiting for a trigger. We draft agreements to survive the dispute you hope never comes.
Negotiable instruments, above all the cheque, carry a double edge in Pakistan: dishonour can trigger both criminal proceedings and civil recovery. Which track to choose — or whether to run both — is a strategic decision that shapes the entire matter. We make it deliberately, with the client's objective in view.
What Our Banking Practice Covers
Both sides of the ledger, argued precisely.
Banking Court Representation
Suits and defence before the Banking Courts under the special recovery regime — pleaded with the precision that forum demands.
Recovery Suits
Structured recovery actions for financial institutions and businesses: the right forum, the right sequence, documentation that holds.
Borrower Defence
Limitation, mark-up disputes, and procedural defects in the lender's case — assessed honestly, argued on the statement of account.
Commercial Contract Drafting & Review
Agreements covering parties, scope, payment, timelines, breach and dispute resolution — drafted to survive disagreement.
Cheque Dishonour Matters
Criminal and civil tracks for bounced cheques, chosen strategically — because the right track decides the outcome.
Finance Facility Documentation
Documentation for lending and borrowing facilities — reviewed before signature, when problems are still cheap to prevent.
How an Engagement Works
Position Review
Facility documents, statements of account, contracts and correspondence are examined. In banking matters, the paper trail is the case.
Strategy
Claim or defence, civil or criminal track, Banking Court or ordinary forum — the route is chosen deliberately and explained to you plainly.
Proceedings
Pleadings drafted with precision, evidence organised around the documents, and every hearing actively pursued — no adjournments sought by us.
Recovery / Resolution
Decree, settlement or restructuring: the objective is recovery in hand, not just a judgment on paper.
Built for Borrowers, Lenders and Businesses
Banking and commercial law serves both sides of every transaction. We act for:
- Borrowers facing recovery proceedings — defence on limitation, accounts and procedure.
- Banks and financial institutions recovering dues — structured, compliant recovery strategy.
- Businesses in commercial contract disputes — enforcement of agreements and negotiated exits.
- Parties in cheque dishonour cases — on either side of the bounced instrument.
In banking matters, the statement of account is the battlefield. We reconcile it line by line — because that is where these cases are actually won.
Special-Forum Experience
Banking law is its own jurisdiction — we practise in it daily.
Banking Court experience
The special procedure, the pace, the pleading standards: mastered through practice, not learned on your case.
Both sides of the table
Having acted for borrowers and institutions alike, we anticipate the other side's move before it is made.
Documentation discipline
In finance disputes, the file wins before the hearing. Ours are built that way.

Common Questions on Banking & Commercial Law
What is a Banking Court?
A special court established for finance-related disputes — primarily suits by and against financial institutions — operating under its own law and procedure, distinct from ordinary civil courts. The pace is faster and the pleading requirements are specific. We practise before these courts regularly.
What happens if a cheque bounces?
Both criminal proceedings and a civil suit for recovery may be available. Which track to pursue — or whether to run both — depends on the facts, the amount, and what you actually want to achieve. We assess the position and choose strategically rather than reflexively.
Can a bank freeze my account?
Only through lawful process. If an account has been frozen or debited without proper authority, that action can be challenged. We examine what was done, under what power, and move against unlawful action promptly.
What defences exist against a recovery suit?
Depending on the case: limitation, incorrect computation of the amount claimed — including mark-up disputes — and procedural defects in the institution's own documentation and process. Every defence must be proved on the record; we assess yours honestly before promising anything.
How is a recovery suit different from an ordinary civil suit?
It proceeds under special law before a special court, with its own procedure for pleadings, evidence and execution — generally faster and more document-driven than an ordinary civil suit. The strategy, and the lawyer, should match the forum.
What should a commercial contract always contain?
At minimum: clearly identified parties, defined scope of work, payment terms and timelines, consequences of breach, and a dispute-resolution mechanism. Most contract disputes we see trace back to one of these being vague. We draft and review agreements so that none of them are.
